MANJARI NEHRU KAUL , J. (ORAL) In compliance of order dated 01.12.2023, medical status report by way of affidavit of Superintendent, Central Jail, Kapurthala, has been filed in Court, which is taken on record. 2.

As per the medical report of the Medical Officer, Central Jail, Kapurthala, which has been annexed with the affidavit as Annexure R-1, petitioner is a known case of spinal injury and lower limb paralysis. He had been referred to Department of Neurosurgery, GNDH, Amritsar, on 19.04.2023 with complaint of pain in his lower back etc., where after being examined by specialist doctors and being managed, he was sent back to the jail. However, on 25.10.2023, he was again referred to Department of Surgery at Civil Hospital, Kapurthala, with complaint of backache, bedsores and wound on the left leg and thereafter, he remained there. Though the petitioner has since been discharged from the hospital at Kapurthala and admitted back in jail on 16.11.2023, his condition is stable and his vitals are within the normal PUNEET SACHDEVA 2023.12.08 09:21 I attest to the accuracy and integrity of this document.

CRM-M-59340-2023 -2limits, however, it has not been disputed by the learned State counsel that he has indeed developed bedsores.

In the wake of the medical condition of the petitioner, this Court deems it fit to extend the concession of interim bail to him for a period of three months from today on medical grounds subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.

It is, however, made clear that the petitioner would cooperate with the Court proceedings and would not seek any unnecessary adjournments.

The petitioner shall surrender back to the jail authorities concerned on 08.03.2024 before 05:00 P.M.

The instant petition stands disposed of accordingly. 7.

It may be clarified that in case the petitioner misuses the concession of interim bail, the State would be at liberty to approach this Court for cancellation of the same.
