Allowed, as prayed for.

Main case Prayer is for grant of anticipatory bail in case FIR No.0056 dated 29.06.2019 under Section 22 of NDPS Act registered at P.S Sadar Nawashahr, District SBS Nagar.

As per allegations, 60 injections of Buprenorphine each containing 02 ml each, 40 injections bearing Batch No.IL-19007 and 20 injections bearing Batch No.RX-136 were found in possession of the petitioner.

Learned counsel for the petitioner contends that false recovery has been foisted upon the petitioner. The petitioner is HIV positive and has been suffering from Hepatitis C Virus apart from kidney ailments. He is in custody since 29.06.2019 and that the trial is not making any headway due to Covid-19 pandemic. On the other hand, learned State counsel has submitted that investigation is complete and the trial has commenced. Out of 12, two witnesses have already been examined.

Without commenting anything on the merits of the case and also bearing in mind the medical condition of the petitioner coupled with the fact that the trial may take sufficient time to conclude, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Jaspal Singh @ Jassa is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
