(ORAL) The petitioner is seeking regular bail in FIR No. 00122 dated 10.11.2019 under Section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985 ('Act' for short) registered at Police Station Sadar, District Gurdaspur and later on offence under Sections 22, 29, 29-A, 61 and 85 of the Act were added.

Learned counsel for the petitioner at the outset states that in the present case, the FSL report has not been received yet. This factum has not been disputed by the learned State counsel. As per the Division Bench of this Court in case of 'Inderjeet Singh @ Laddi and others versus State of Punjab 2014(3) R.C.R. (Criminal) 953' in the case where the FSL report is awaited and is likely to be delayed, the accused can be released on interim bail. CRM-M No. 54498 of 2019 -2merits, lest it should prejudice the case of either side, the petitioner is granted interim bail, subject to furnishing bail/surety bonds to the satisfaction of the learned trial Court/Duty Magistrate, till the receipt of FSL report. On receipt of FSL report, the petitioner would surrender before the learned trial Court.

Petition stands disposed of accordingly.
