Prayer in the second petition under Section 439 of Code of Criminal Procedure is for grant of regular bail to the petitioner in case FIR No. 23 dated 05.04.2023 registered for the offences punishable under Sections 379-B, 34 of IPC (Section 411 of IPC added later on) at Police Station Jhandher, District Amritsar Rural. 2.

On the last date of hearing, direction was given to the learned trial Court to record the statements of the complainant(s) and to submits its report in this regard. As per the report submitted by the learned trial Court complainant-Gursewak Singh and another victim Nirmal singh while appearing in the witness box as PW-1 and PW-2 failed to identify the accused persons.

As per the custody certificate furnished by the State counsel, petitioner is in custody for the last more than 10 months. 4.

In the given circumstances, no useful purpose is going to be served by detaining the petitioner in custody for any longer period. 5.

In light of the above, without expressing any opinion on the Priyanka Thakur 2024.03.05 13:24 I attest to the accuracy and integrity of this document merits of the case, the present petition is allowed and the petitioner is
