JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in FIR No.327 dated 13.10.2019, under Sections 379, 379A and 120-B IPC, registered at Police Station City Mandi Dabhwali, District Sirsa.

Learned counsel for the petitioners has argued that the present FIR was registered on the basis of complaint of Amandeep Singh son of Harpal Singh that on 13.10.2019, when he along with his wife were attending Nagar Kirtan at around 4:30 P.M., one unidentified woman RAJ KUMAR ARORA 2019.12.20 17:24 I attest to the accuracy and integrity of this document

CRM-M-53013-2019 (O&M) snatched the gold chain weighing 15 gms. from the neck of his wife. Thereafter, alarm was raised, however, the unidentified lady succeeded in fleeing away in the crowd of Nagar Kirtan. He further expressed doubts regarding the same including 3-4 ladies in this regard. This Court has heard the learned counsel for the petitioner.

From the perusal of paper book, it can be seen that in the present case, the police has arrested some persons including Bittu, Kala Singh and Ram Lal and it has been found that there is a gang of snatchers operating in the area and about 250 gms. of gold has also been recovered from the co-accused Nathi, Joto and Bhimo in two other criminal cases as well.

In view of the seriousness of the offence, it can safely be presumed that there is a network of gang operating in the area and therefore, gravity of the offence seems to be large.

Considering the totality of circumstances, this Court deems it a fit case not to grant the concession of anticipatory bail to the petitioners and consequently, the present petition is dismissed. However, anything observed hereinabove shall not be treated as an expression of opinion on merits of the case and is meant for the purpose of deciding the present petition only. December 12, 2019.
