RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for issuance of direction to the respondents to provide the clean water/drinking water to the village Mugalpura, District Hisar.
In response to the notice issued, learned State counsel has filed the status report, dated 22.12.2023, by way of affidavit on behalf of respondents No.1 to 4. The same is taken on record. It has been submitted by learned State counsel that the work is being carried out regarding the laying down of the pipe line with DI pipes as per the program, namely, `JJM' Jal Jeevan Mission introduced by Government of Haryana for replacement of old and damaged drinking water pipelines with DI Pipes and the work of replacement has almost completed in the village so as to ensure clean drinking water to the villagers. It is submitted that AC Pipelines were brushed with the passage of time and were MEENU 2023.12.28 04:52 I attest to the accuracy and integrity of this document
CWP-26730-2023 -2many times at different points. Thus, the same require replacement for supply of clean and portable drinking water. She has further drawn attention of this Court to the affidavit filed and has stated that requisite program is at advance stage, however, the residents of village Mugalpura had filed CWP3909-2023 in which this Court has directed for maintaining the status quo and hence further work remains to be done awaiting the decision of the Court in the said writ.
On hearing the learned counsel for the parties and perusing the record, it is apparent that the work for replacing all the pipes for providing clean water is already being carried out, however, completion of the same remains to be done awaiting the decision in the writ already filed by the villagers.
In view of the above-mentioned facts, the present petition is disposed of considering the submissions made in the affidavit, filed by learned State counsel today in Court. However, petitioners are at liberty to pursue their remedies as available to them in accordance with law in case further cause of action accrues to them.
