The present appeal pertains to the year 2020 and repeatedly the same has been adjourned on the request of the learned counsel for the appellant.

Learned counsel for the caveator-respondent No.1 has pointed out that the sale deed has since been executed and the mutation has also been sanctioned. Learned counsel has further pointed out that a suit for partition has also been filed.

Today the matter has been called twice, however, none has put in appearance on behalf of the appellant. It appears that the appellant is not interested in pursuing the present appeal. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 4.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
