The present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR No.42 dated 26.08.2023 under Sections 452, 324, 323, 148 and 149 of the Indian Penal Code, 1860 (Section 307 of IPC added later on vide DDR No. 34 dated 01.09.2023 and Sections 325 and 326 of IPC added later on vide DDR No. 16 dated 13.09.2023) registered at Police Station Kot Fatta, District Bathinda (Annexure P-1).

Vide order dated 24.11.2023, this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation.

Learned State counsel on instructions from ASI Jasjeet Singh submits that the petitioner has joined the investigation and his custodial interrogation is no longer required.

In light of the above, the present petition is allowed. The order dated 24.11.2023 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency, and shall abide by the conditions of Section 438 (2) Cr.P.C.

However, it is made clear that this order shall not be construed as parity qua any other co-accused.
