RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of directions to the official respondents to make an inquiry regarding committing a fraud regarding the panchayat funds approximately to the tune of Rs.65 lakhs by respondent No.8 regarding the grant of money, received by the panchayat of village Boorwala, regarding auction of panchayat land and regarding other funds, received from time to time by the panchayat with a further prayer for issuance of direction that after inquiry to recover the amount from the last private respondent, under the provision of Section 216 of the Punjab Panchayati Raj Act, 1994 and to deposit the money in the panchayat account so that the money may be used for the development of Gram Sabha/village.
It is further prayed to direct the official respondents to get registered FIR qua embezzlement of panchayat funds by respondent No.8. It is further prayed to direct the official respondents to consider and decide the representations, dated 25.09.2023, Annexures P1 and P2. MEENU 2023.12.
CWP-26824-2023 -2It has been contended by learned counsel for the petitioner that he has already filed representations, dated 25.09.2023, Annexures P-1 and P2, for redressal of his grievances, however, no action has been taken on the same till date.
Notice of motion.
On the asking of the Court, Ms.Akshita Chauhan, Deputy Advocate General, Punjab, who is present in Court, accepts notice on behalf of the respondents/State and submits that the inquiry has already been initiated against the Sarpanch and the same is pending before respondent No.5-DDPO.
In view of the above statement made by learned State counsel, the present petition is disposed of with a direction to respondent No.5 to conclude the inquiry initiated expeditiously in accordance with law preferably within eight weeks from today.
