**** HARSIMRAN SINGH SETHI, J. (Oral) Learned counsel for the petitioner submits that against the order of punishment dated 31.03.2010 by which the penalty of Rs. 1,44,000/- was imposed upon the petitioner, the petitioner had filed an appeal on 11.05.2010, copy of which has been appended as Annexure P-9 with the respondents-Department but the said appeal has not been decided by the respondents department despite expiry of more than one decade, hence the respondents are under an obligation to decide the said appeal filed by the petitioner in a time bound manner so that the petitioner does not suffer any prejudice.

Notice of motion.

On asking of the Court, Mr. Harish Nain, AAG, Haryana accepts notice on behalf of respondents-State and submits that in case the appeal dated 11.05.2010 (Annexure P-9) filed by the petitioner against the order of punishment has been received in the office of authorities concerned and the same is still pending consideration with the authorities concerned, RIYA 2023.12.02 12:32 I attest to the accuracy and integrity of this document

CWP-26967 -2023 (O&M) 2023:PHHC:152818 the same will be decided by the competent authority within a period of eight weeks of the receipt of certified copy of this order by passing an appropriate speaking order.

Learned State counsel further submits that in case the said appeal has already been decided by the competent authority, it will be ensured that the order already passed in the said appeal is also brought to the notice of the petitioner for his information and necessary action if not already conveyed.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further with liberty to the petitioner to avail the appropriate remedy available to him in case any of the grievance of the petitioner still persists.

Ordered accordingly.
