The petitioners have approached this Court seeking grant of anticipatory bail in respect of a case registered against them vide FIR No.137, dated 23.11.2019, under Sections 323, 324, 295, 34 IPC, Police Station Sujanpur, District Pathankot.

At the time of issuance of notice of motion the following order was passed:

" It is contended by learned counsel for the petitioners that the case against the petitioners is concocted. Otherwise also, it is a case of version and cross version, in which the son of petitioner No.1 was also caused injury by the other side. In any case, even as per the case of the complainant, it is a case relating to simple injury.

Meanwhile, in the event of arrest, the petitioners be released on interim bail subject to their furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C." 3.

The learned State counsel, upon instructions from ASI Surinder Kumar, has informed that pursuant to interim directions issued by this Court, the petitioners have since joined investigation and that it is a case of cross-versions. It has further been informed that the petitioners are not wanted in any other case. 4.

Having regard to the aforestated facts and circumstances particularly that it is a case of cross-versions and that the petitioners have already joined investigation and are not involved in any other case, the petition is accepted and the interim directions issued by this Court vide order dated 13.12.2019 are hereby made absolute subject to the condition that the petitioners shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
