CRM-M-54812-2024 (Main Case) 1.

The petitioner seeks grant of interim bail for a period of 3 weeks so as to attend the marriages of his real sister Avnish as well as his real brother Deepak @ Jatt, which as per the assertions of the petitioner are to be solemnized on 9.11.2024 and 10.11.2024, respectively. 2.

Pursuant to issuance of notice of motion and a specific direction issued by this Court to the respondent-State vide order dated 5.11.2024, learned State counsel has got the necessary verification conducted. Learned State counsel, upon instructions from ASI Yadwinder Singh, has stated that upon Pankaj Kakkar 2024.11.06 14:18 I attest to the accuracy and authenticity of this document

CRM-M-54812-2024 (O&M) ( 2 ) verification, it has been confirmed that the marriages of Avnish and Deepak @ Jatt i.e. real sister and real brother of the petitioner are to be solemnized on 8.11.2024 and 10.11.2024. Learned State counsel has today passed on statements of various residents of the village including that of Sarpanch, wherein the factum as regards marriage of real sister and real brother of the petitioner has been verified. The aforesaid statements are taken on record. 3.

Having regard to the facts and circumstances of the case particularly bearing in mind that the petitioner's real sister as well as real brother are to get married on 8.11.2024 and 10.11.2024, respectively, it goes without saying that the petitioner would be required to perform certain rites and ceremonies in respect of marriage of his real sister and real brother and he would also be required to make necessary arrangements in connection with marriage of his real sister and real brother. The instant petition, as such, is allowed and the petitioner is ordered to be released on interim bail forthwith upto 15.11.2024 subject to his furnishing bail bonds/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned. 4.

The petitioner, after availing interim bail shall surrender before the Jail Authorities on the morning of 16.11.2024 by 10:00 A.M .
