Reply by way of affidavit of Shri Davinder Singh, PPS, Deputy Superintendent of Police, Rural Bathinda on behalf of the respondent-State has been filed in the Court which is taken on record. The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.95 dated 2.9.2018 registered for the offence under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the NDPS Act') at Police Station Nandgarh, District Bathinda.

Cr. Misc. No.M-44301 of 2018 [2] has put in appearance on behalf of respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing for the respondent-State and have gone through the record.

As per the prosecution version in the FIR, the present petitioner ran away from the spot and his co-accused was apprehended on the spot. 1000 Tablets of Clovidol-100 SR and 250 tablets of Digifresh 0.5 were recovered in this case.

Keeping in view the facts and circumstances of the present case and the heavy recovery, I do not find it a fit case where the petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
