The instant appeal has been preferred by the appellant-wife - Sandeep Kaur against the judgment and decree dated 05.04.2018 vide which the petition filed by the appellant under Section 13 of the Hindu Marriage Act, 1955 (for short 'the Act') seeking dissolution of marriage was dismissed by the Family Court.

The marriage was solemnized between the parties on 16.01.2008 as per Sikh rites and ceremonies and one female child was born out of the said wedlock.

During the pendency of the appeal, learned counsel for the appellant had moved an application for conversion of petition filed before the trial Court under Section 13 (1) (ia) of the Act into a petition under Section 13-B of the Act. The prayer was allowed vide order dated 19.12.2018 and the parties arrived at a settlement, which was reduced in writing on 20.11.2018. Pursuant to same, they made their statement of first motion stage on 19.12.2018. In view of the fact that the parties stand by their statement made at first motion, marriage between them is dissolved by a decree of divorce.
