(ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.63 dated 08.10.2024 under Sections 115(2), 126(2), 333 of the BNS, 2023 registered at Police Station Bilga, District Jalandhar Rural.

Vide order dated 06.11.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner inter alia contends that the petitioner is the Power of Attorney holder of the co-sharer of the complainant between whom there is some civil dispute pending. It is, thus, obvious for reasons that a false and fabricated version has been brought forth against the petitioner that with a spanner he broke open the locks of the disputed shop and thereafter assaulted the complainant. Learned counsel submits that the injuries allegedly inflicted upon the complainant PUNEET SACHDEVA 2025.02.03 16:15 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-54987-2024 -2were opined to be simple in nature. It has also been submitted that the petitioner has no previous criminal antecedents."

Learned counsel for the petitioner submits that in compliance of order dated 06.11.2024, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions from ASI Vijay Kumar, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. 5.

In view of the above, the petition is allowed and interim order dated 06.11.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
