(Oral) The present petition has been filed under Section 482 Cr.P.C., read with Section 528 of BNSS, 2023, seeking the setting aside of the order dated 16.09.2024 (Annexure P-10) passed by the Court of Judicial Magistrate, First Class, Barnala vide which the petitioner's application for permission to travel abroad has been denied despite being declared innocent in the investigation report in FIR No. 3 dated 06.06.2017, registered under Sections 406 and 498A IPC at Police Station NRI, Sangrur. 2.

In compliance to order dated 08.11.2024, status report dated 11.01.2025 by way of an affidavit of Gurbans Singh Bains, PPS Superintendent of Police, NRI Wing, Patiala on behalf of respondent-State has been filed by learned State counsel in Court today, which is taken on record. Learned State counsel submits that the petitioner has been declared innocent in the investigation report, which was submitted to the Learned trial Court on 09.10.2024. Additionally, it is stated that the local police has no objection to the petitioner being granted such permission. I have heard learned counsel for the parties and perused the record.

In view of the above, the present petition is allowed. Order dated 16.09.2024 (Annexure P-10) is hereby set aside. 5.

The trial Court is directed to look into the matter afresh, considering the facts and circumstances presented in the status report and the latest developments, and to decide the matter expeditiously, in accordance with law.

Pending application(s), if any, shall also be disposed of accordingly.
