Mr. Arun Bansal, Advocate for respondent No.2 **** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.367 dated 25.11.2019 registered under Section 420 IPC, at Police Station Central Sector 17, Chandigarh.

Notice of motion was issued on 13.12.2019 and interim anticipatory bail was granted to the petitioner. Thereafter, vide order dated 12.08.2021, parties were directed to appear before

Mediation and Conciliation Center of this Court on 26.08.2021 for striking amicable resolution of dispute (if any). In compliance of the aforesaid order, parties have successfully deliberated upon the issue and now they have entered into an amicable resolution of dispute, vide a compromise/settlement dated 13.09.2021. The terms and conditions of the compromise have been recorded into writing and parties along with their Advocates have signed the compromise as a token of confirmation.

Learned counsel for the petitioner submits that needful in the context of compromise has already been done. Amount has also changed hands.

Learned counsel for the complainant admits the factum of compromise and pleads no objection for the grant of anticipatory bail to the petitioner. Though, learned Public Prosecutor, UT Chandigarh, has opposed the bail, but the offence is compoundable at the instance of complainant and with the leave of the Court, therefore, I deem it appropriate to grant indulgence.

In view of aforesaid factual position, the interim order dated 13.09.2019 is made absolute. Petitioner shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2)

Cr.P.C.

Let a copy of compromise be supplied to the Investigating Officer within two days, so as to make it a part of record.

Petition stands disposed of.
