The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of orders dated 19.09.2023 (Annexure P-9) and dated 23.10.2023 (Annexure P-10) whereby it has been declined allotment of paddy for KMS 2023-24.

Learned State counsel, who on advance notice is present in Court, submits that second appeal of the petitioner is already pending before appellate authority-Secretary, thus, the present petition is not maintainable. He assures the Court that appeal of the petitioner would be decided within a week from today.
