***** RAJ MOHAN SINGH, J .(Oral) Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.177 dated 17.05.2019, registered under Section 22 of NDPS Act, 1985 and Section 61 of Punjab Excise Act, 2014 at Police Station Phillaur, District Jalandhar.

The FIR was registered on the basis of secret information. The information was confined to smuggling of illicit liquor. The offences under NDPS Act were added. It is not in dispute that on receipt of report of FSL, the offence under Section 22 of NDPS Act has been deleted. GEETA RANI 2020.02.06 16:57 I attest to the accuracy and integrity of this document

CRM-M No.53731 of 2019 (O&M) -2Challan has been presented for the offence under Section 61 of the Punjab Excise Act. Co-accused Raman Kumar @ Raman Sharma @ Munna and Paramjeet Kaur have been released on regular bail on 23.10.2019 in CRM-M No.43331 of 2019 and CRM-M No.31959 of 2019, respectively. The aforesaid facts have not been denied by learned State counsel on instructions from ASI Kulwinder Singh. Petitioner is in custody since 17.05.2019.

In view of the aforesaid position and without meaning anything on the merits of the case, I deem it appropriate to release the petitioner on regular bail.

In view of above, the present petition is allowed and the petitioner is ordered to be enlarged on bail, subject to her furnishing adequate bail bonds/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.

Nothing expressed hereinabove shall be construed to be an opinion on merits of the case.
