1. The petitioner has approached this Court seeking grant of anticipatory bail in a case registered against him vide FIR No.169 dated 11.11.2019 under Section 61 of Excise Act, at Police Station Badhni Kalan, District Moga.

2. The FIR was lodged on the basis of secret information received to the effect that the petitioner was indulging in sale of liquor made in Haryana and that in case a raid is conducted heavy quantity of liquor can be recovered from him. Upon receipt of information, a raid was conducted at the nominated place and 240 bottles of liquor meant for sale in Haryana was recovered. However, the petitioner could not be nabbed as he is stated to have run away from the spot.

3. Pursuant to interim directions issued by this Court vide order dated 16.12.2019, the petitioner is stated to have joined investigation.

4. Having regard to the facts and circumstances of the case and that the petitioner was not arrested at the spot, in my opinion, it is not a case which would warrant custodial interrogation. The petition, as such, is accepted and the interim directions issued by this Court vide order dated 16.12.2019 are hereby made absolute subject to the condition that the petitioner shall continue to appear before the Investigating Officer as and when called upon to do so and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
