1. The petitioners have filed this writ petition seeking relief of monetary benefits/arrears due from the respondent department along with interest @12% p.a. on the basis of a judgment dated 16.01.2015 passed in CWP-224292014 titled as Gurbir Singh and others vs. Punjab and Haryana High Court being similarly situated employees.
2. This Court finds that while the petitioners state themselves to be similarly situated, facts are otherwise. The petitioners are appointed in the Industries and Commerce Department as restorer, and are not employees of the Punjab and Haryana High Court.
3. The claim, thus put up by the petitioners of being similarly situated employees, is found to be wholly false and the writ petition thus attempts to mislead.
4. This is a court of equity. Under Article 226 of the Constitution of India, such a petition would therefore not be entertained.
5. Writ Petition is dismissed accordingly.
