Learned counsel appearing on behalf of the petitioner(s) contends that the petitioner has already moved an application for recalling of the summoning order dated 18.01.2024 wherein notice has already been issued.

Since the matter is under active consideration before the Illaqa Magistrate, hence, pendency of the present petition would not serve any purpose as the petitioner would have a fresh cause of action to approach the competent Courts after an order is passed on such a pending application.

In view of above, counsel for the petitioner does not press the instant petition at this stage with liberty to raise all the issues again after the decision in the application for recalling the order dated 18.01.2024 pending before the concerned Illaqa Magistrate.
