Dated Police Station Sections 14.09.2024 City Banga, District SBS Nagar 420 IPC (318 (4) BNS, 2023) The petitioner apprehending arrest in the FIR captioned above has come up before this Court under Section 482 BNSS, 2023, seeking anticipatory bail. Counsel for the petitioner submits that the matter has been settled in the Mediation and Conciliation Centre of this Court. 3.
Counsel for the complainant also submits that the matter has been settled. However, the money has to be returned in five installments ending in August. Counsel further submits that in case, the petitioner does not return the money then complainant should be permitted to file an application for cancellation of bail before this Court or before the Sessions Court.

State counsel opposes the petition based on reply dated 10.12.2024 filed by State.

Given the settlement, the present petition is allowed. In the event of arrest, the petitioner shall be released on bail on furnishing bail bonds to the satisfaction of the Investigator. It is clarified that in case that this bail has been granted only because of the settlement and the assurance made by the petitioner to pay the entire amount to the complainant as per the terms of the settlement. Present petition is allowed with aforesaid observation.
