Learned State counsel submits that the petitioner is in custody only for 10 months and 23 days. It is a case where three persons have died and the petitioner was found to be under the influence of intoxicant substance while driving the commercial vehicle and the complainant in such a case is necessary to be examined, in view of which, learned counsel for the petitioner prays for withdrawal of the present petition, at this stage. 2.

Ordered accordingly.
