(1) Subject to the provisions of sub section (2), any person aggrieved by an award of a Claims Tribunal may, within ninety days from the date of the award, prefer an
appeal to the High Court:
Provided that no appeal by the person who is required to pay any amount in terms of such award shall be entertained by the High Court unless he has deposited with it twenty1five thousand rupees or fifty per cent. of the amount so awarded, whichever is less, in the manner directed by the High Court:
Provided further that the High Court may entertain the appeal after the expiry of the said period of ninety days, if it is satisfied that the appellant was prevented by sufficient cause from preferring the appeal in time.
(2) No appeal shall lie against any award of a Claims Tribunal if the amount in dispute in the appeal is less than [one lakh] rupees."

"31. After we have heard learned Counsel for the parties at length, the following questions emerges for our consideration in the present batch of appeals are as under: xxx xxx xxx
4. Whether the condition of pre1deposit under proviso to Section 43(5) of the Act for entertaining substantive right of appeal is sustainable in law?

121. Before we examine the challenge to the proviso to Section 43(5) of the Act of making pre deposit for entertaining an appeal before the Tribunal, it may be apposite to take note of Section 43(5) of the Act, 2016. Section 43(5) reads as follows:
"43. Establishment of Real Estate Appellate Tribunal
.......
(5) Any person aggrieved by any direction or decision or order made by the Authority or by an adjudicating officer under this Act may prefer an appeal before the Appellate Tribunal having jurisdiction over the matter: Provided that where a promoter files an appeal with the Appellate Tribunal, it shall not be entertained, without the promoter first having deposited with the Appellate Tribunal at least thirty per cent of the penalty, or such higher percentage as may be determined by the Appellate Tribunal, or the total amount to be paid to the allottee including interest and compensation imposed on him, if any, or with both, as the case may be, before the said appeal is heard.
Explanation - For the purpose of this Sub section "person"
shall include the association of allottees or any voluntary consumer association registered under any law for the time being in force."

% "RESPECTFULLY SHOWETH:
1. That the accompanying appeal has been filed by the appellant/ applicant in this Hon'ble High Court which is likely to succeed on the grounds mentioned therein.
2. That the appellant/ applicant is a poor person and not able to deposit the amount Rs.25,000/ which have to be deposited at the time of filing the present appeal.
It is, therefore, respectfully prayed that the appellant may kindly be exempted from depositing the amount of Rs.25,000/ for filing the present appeal in the interest of justice and fair play.
