The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to decide his representations dated 10.07.2025 and 02.08.2025 and allow him to join as Security Guard against advertisement dated 09.01.2024. 2.

The petitioner pursuant to advertisement dated 09.01.2024 applied for the post of Security Guard. Two posts were advertised. The respondent conducted interview on 17.01.2024.

candidates participated in the selection process and respondent No.3-Mahinder Kumar and Mangat Ram came to be selected. Petitioner was at Serial No.1 in the waiting list. He claims that respondent No.3 has been wrongly selected. As per petitioner, height of selected candidate Mahinder Kumar is less than prescribed standard.

Learned counsel for the respondent, who on advance notice is present in Court, submits that prescribed standard height is 5'6" and selected candidate was measured by recruitment agency and found him 5'6". There was no favouritism or misuse of process 4.

In the absence of concrete evidence, this Court cannot conclude merely on the basis of bald averments that selected candidate is not possessing height of 5'6" especially when height of 5'6" is not an abnormal height for male candidates.

Faced with this, learned counsel for the petitioner submits that petition may be dismissed as withdraw with liberty to raise issue of height, if at any stage, he gets positive evidence. 6.

Dismissed as withdrawn with aforesaid liberty. 7.
