JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in FIR No.535 dated 22.11.2019, under Section 61 of the Punjab Excise Act, 1914 and Section 420 IPC, registered at Police Station Tosham, District Bhiwani.
Learned counsel for the petitioner has argued that the petitioner has been wrongly roped in, in the present FIR because he was neither the owner of the truck nor was named in the FIR but he has been RAJ KUMAR ARORA 2020.02.10 11:28 I attest to the accuracy and integrity of this document
CRM-M-54037-2019 (O&M) later on nominated on the basis of disclosure statement made by co-accused. On 18.12.2019, while issuing notice of motion, interim protection was granted to the petitioner subject to his joining investigation and complying with the provisions contained under Section 438 (2) Cr.P.C. Learned State counsel, on instructions from ASI Ram Dhari, states that the petitioner has joined investigation and has fully cooperated with the investigation process and that he is no more required for custodial interrogation.
In view of above stand taken by the learned State counsel, the present petition is allowed. Interim order dated December 18, 2019, is hereby made absolute.
