Manpreet Singh v. State Of Punjab And Another

2019-12-16Mr. Justice Amol Rattan Singh2 pages

In the High Court of Punjab and Haryana, at Chandigarh Criminal Misc. No. M-53664 of 2019 Date of Decision: 16.12.2019 Manpreet Singh ... Petitioner(s)

Versus

State of Punjab and Another ... Respondent(s) CORAM: Hon'ble Mr. Justice Amol Rattan Singh

Present:

Mr. Raj Kaushik, Advocate for the petitioner(s).

Amol Rattan Singh, J.

By this petition, the petitioner challenges the orders passed by the learned Courts below, dismissing his application seeking the release of his bus on "sapurdari".

Without going into any further detail of the matter, what is essential to be noticed is that in the impugned order, it has been very clearly brought out by the learned appellate court, that the petitioner got a temporary registration number for his vehicle for the period 03.03.2016 to 20.04.2016, but did not get a permanent registration number for the bus and kept plying it for a period of about three years, and thereafter when the bus met with an accident, it was discovered that the number of the bus (as was being used on it) was actually a registration number of a motorcycle. Though learned counsel for the petitioner has tried to clarify that only because of one particular letter (T) being missing from the number plate of the bus, it was held that the petitioner was illegally plying the bus DEEPAK KUMAR BHARDWAJ 2019.12.19 12:12 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-53664 of 2019 with the registration number of a motorcycle, however, that fact may be something to be proved before the learned trial Court in the proceedings before it, but simply owing to the fact that the petitioner was admittedly plying the bus without a permanent registration number for three years, I see absolutely no ground to release the bus on "sapurdari". Dismissed.
