Main case As observed in the previous order, none had made appearance on behalf of the respondent, despite service. Today also, none has made appearance on his behalf. As such, respondent is proceeded against ex parte. The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/242/2025 titled 'Gurpreet Singh v/s Lovepreet Kaur', filed by the
respondent-husband, pending in the Family Court, Sangrur and she seeks transfer of the same to the Court of competent jurisdiction at Bathinda. Counsel for the applicant heard.
At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 24.11.2024. On account of matrimonial dispute, the applicant was turned out of the matrimonial house on 18.04.2025. The applicant was stated to be pregnant at that time. Even now, she is eight months' pregnant. It is also submitted that she has no source of earning. She has filed the petition under Section 144 of Bharatiya Nagarik Suraksha Sanhita as well as the petition under the Protection of Women from Domestic Violence Act, which are pending in the Courts at Bathinda and the respondent is pursuing both the said petitions. The distance between the two places is stated to be about 100 kms.
In view of the constrained circumstances faced by the applicant, as stated aforesaid and also taking into consideration the fact of the applicant not having any source of earning as well as two cases arising from the matrimonial dispute, already pending in the Courts at Bathinda and also the fact of the respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/242/2025 titled 'Gurpreet Singh v/s Lovepreet Kaur', filed by the respondent-husband, stands transferred from the Family Court, Sangrur, to the Court of competent jurisdiction at Bathinda. The requisite record of the aforesaid case be sent by the Family Court, Sangrur, to the District and Sessions Judge, Bathinda.
Learned District and Sessions Judge, Bathinda, shall assign the said petition to the Family Court, Bathinda. Even, the parties are directed to appear before the Family Court, Bathinda, within a period of one month from today onwards.
