Respondent proceeded against ex parte vide order dated 21.03.2025.

***** ARCHANA PURI, J. (Oral) At this stage, the counsel for the applicant submits that as observed in the order dated 21.03.2025, he was to apprise the Court about the stauts of the complaint filed by the applicant, to Senior Superintendent of Police, Sangrur. He submits that as per the talk of compromise earlier going on, the said complaint was withdrawn by the applicant. However, the compromise did not materialise and the parties stand, where they were standing at the time of filing of the transfer application. Upon notice, the respondent did not make appearance, despite service and as such, was proceeded against ex parte. The counsel for the applicant heard.

,  +"+   It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 04.12.2022. One son born from the said wedlock, who is about 1 year old, is in the care and custody of the applicant. Also, it is submitted that the applicant is not having any source of earning and is totally dependent upon her parental family. Earlier, the applicant had filed one complaint before Senior Superintendent of Police, Sangrur. However, under the cover of an attempt for making amicable settlement between the parties, the said complaint was withdrawn. Later on, the respondent did not agree for the amicable settlement.

In these circumstances, it is submitted that it is difficult for the applicant to commute a distance of about 80 kilometres, to defend the petition under Section 9 of the Hindu Marriage Act, filed by the respondent.
