The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue his passport.

The petitioner was issued passport on 28.07.2008 which was valid upto 27.07.2018. The petitioner vide application dated 09.07.2018 applied for re-issuance of passport. An FIR No. 105 dated 13.11.2017, under Section 306, 506 of IPC came to be registered against the petitioner at Police Station, Fatehgarh Churian, Police District Batala (Distt. Gurdaspur). The police after completing investigation filed cancellation report. Trial court did no accept the cancellation report and directed the police authorities to make further investigation. The petitioner preferred CRM-M-24124 of PARAMJIT KAUR SAINI 2023.11.30 15:31 I attest to the accuracy and authenticity of this order/judgment

CWP No.26813 of 2023 -2- 2023:PHHC:152112 2021 before this Court seeking quashing of afore-mentioned FIR. This Court vide order dated 22.02.2022 disposed of the said petition with a direction to Magistrate to ensure that cancellation report and the protest petition be decided within three months. The police till date has not filed further report.

Learned counsel for Union of India, who on advance notice is present in Court, submits that application of the petitioner which was filed in 2018 stands closed, thus, petitioner is required to file fresh application which would be disposed of, in accordance with law. 4.

The petition stands disposed of with liberty to the petitioner to file a fresh application. This court is sanguine of the fact that passport authority would decide application of the petitioner, if filed, in accordance with law.
