Petitioner, an accused in case FIR No.37 dated 24.02.2025 registered against him, for commission of offences punishable under Section 21(b) of NDPS Act (Section 27-A, 61, 85 of NDPS Act added lateron) at Police Station Bhattu Kalan, District Fatehabad, has prayed for grant of pre-arrest bail. Learned counsel for the petitioner submits that one Sunny, s/o Subhash, r/o Kath Mandi, Fatehabad, was allegedly caught red handed at the site keeping in his illegal possession 7 grams of Heroin. It was in the disclosure statement of abovementioned Sunny that name of co-accused Mandeep cropped up, who in turn disclosed that the contraband had been purchased from the present petitioner. Learned counsel further submits that said disclosure statement, in the absence of recovery of any other incriminating material, is not admissible in evidence. Learned counsel further submits that petitioner is willing to join the investigation as and when called for by the IO. Notice of motion.

In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).
