The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.108 dated 2.12.2019 at Police Station City Nuh, District Nuh under Sections 323, 332, 353, 186 and 506 of Indian Penal Code.

The FIR was lodged at the instance of Surender posted as Ahlmad in the Court of learned District and Sessions Judge, Mewat, wherein it has been alleged that on 29.11.2019 when he went to the copying agency to deliver one file, then Ajay Panchal (petitioner) stared at him very angrily and also tried to slap him but the complainant was rescued by Nishan, Copiest. The learned counsel for the petitioner has submitted that it is a case of some verbal duel between two employees of the same department and that even as per FIR no injury had been caused by the petitioner. 4.

Opposing the petition, the learned State counsel has submitted that since the petitioner is specifically named in the FIR, no case for grant of bail is made out. It has, however, been informed that pursuant to interim directions, the petitioner has joined investigation.

I have considered rival submissions addressed before this Court. 6.

Having considered rival submissions addressed before this Court and while bearing in mind the nature of allegations, custodial interrogation of the petitioner is not warranted. The petition, as such, is accepted and the interim directions issued by this Court vide order dated 16.12.2019 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
