The present petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking a writ in the nature of Mandamus/Certiorari for setting aside the order dated 31.01.2024 (Annexure P-2) passed by respondent No.3.

Learned counsel for the petitioner informs the Court that the aforesaid order dated 31.01.2024 (Annexure P-2) has already been challenged by the petitioner before learned Financial Commissioner by filing Revision Petition along with application for condonation of delay, which is pending consideration before the concerned Authority for 08.11.2024. CWP-30021-2024 (O&M) -2submitted that the petitioner would be satisfied if appropriate direction is issued to respondent No.1 for deciding the application seeking condonation of delay filed along with appeal filed by the petitioner, in a time bound manner.

Learned State counsel, appears in pursuance of an advance copy of Writ Petition served upon the State of Punjab. He submits that the application seeking condonation of delay filed by the petitioner along with the aforesaid Revision Petition shall be considered and decided by the concerned Officer/Authority on the date fixed i.e. 08.11.2024 after affording due opportunity of hearing to the petitioner. 4.

Learned counsel for the petitioner, keeping in view the aforesaid submissions made by learned State counsel, submits that she does not intend to press the instant writ petition any further, at this stage. 5.

Keeping in view the submissions made by learned counsel for the parties, the present writ petition is disposed of accordingly. 6.
