The 2nd petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.48 dated 10.05.2022, registered under Sections 21, 22, 25 and 29 of NDPS Act, at Police Station Barnala, District Barnala.

Learned State counsel submits that the petitioner is in custody for 1 year, 6 months and 26 days and out of 79 prosecution witnesses, only 5 witnesses have been examined and 4 have been given up and the next date of hearing is 16.01.2024. There are 2 convictions under the NDPS Act against the petitioner.

After arguing for some time, learned counsel for the petitioner prays for withdrawal of the instant petition at this stage. However, he prays that the trial be concluded within a time bound manner. 4.

Dismissed as withdrawn at this stage.

The trial Court to make an endeavour to conclude the trial expeditiously.
