Prayer in the second petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.38 dated 12.03.2023 registered under Sections 22 and 29 of the NDPS Act, 1985 at Police Station Kot Ise Khan, District Moga.

Learned State counsel submits that the petitioner is behind bars for only 04 months and 19 days and is involved in 03 more cases under the NDPS Act. The first bail application was withdrawn on 05.09.2023. 3.

In view of the above, learned counsel for the petitioner prays for withdrawal of the present petition, at this stage. 4.
