Learned counsel for the petitioner submits that though the present petition has been filed for the grant of regular bail to the petitioner but keeping in view the fact that the trial is not preceding at a pace required for, the petitioner will be satisfied at this stage in case, a direction is issued to the trial Court to conclude the trial in a time bound manner so that petitioner does not suffer indefinite incarceration. 2.

Learned counsel for the respondents concedes that all the prosecution witnesses who are yet to be examined are official prosecution witnesses and statement has been made at bar by the learned counsel for the respondents that all the official prosecution witnesses will appear before the trial Court on the day for which they are summoned without there being exception unless and until, any of the official prosecution witnesses unable to appear due to circumstances which are beyond his/her control. 3.

Keeping in view the above, the present petition is disposed of with a direction to the trial Court to conclude the trial within a period of six RIYA 2023.12.06 16:13 I attest to the accuracy and integrity of this document

CRM-M-59924-2023 (O&M) 2023:PHHC:154889 months from the next date of hearing, even if, the presence of the official prosecution witnesses is to be summoned through coercive order and by giving short adjournment.

It is further made clear that trial Court will be within its jurisdiction to direct the administrative authority of the official prosecution witnesses to take appropriate action including initiation of disciplinary proceedings in case any of the official prosecution witness does not turn up for his/her testimony despite being summoned by the trial Court and not having valid justification for his/her absence. 5.
