Present petition has been filed for seeking quashing of FIR No.11, dated 09.02.2024, registered under Sections 120-B, 420, 467, 468, 471 of IPC, registered at Police Station Cyber Police Station, District Rohtak, later on added Sections 411, 201 of IPC, Sections 66-C, 66-D of IT Act and Section 14 of the Foreigner Act, 1946 (Annexure P-1) as well as all subsequent proceedings arising therefrom, on the basis of compromise dated 28.08.2024 (Annexure P-2).

Learned State counsel has filed the reply dated 07.01.2025, by way of affidavit of YVR Sashi Sekhar, IPS, Assistant Superintendent of Police, Headquarters, Rohtak, on behalf of respondent No.1 - State, which is taken on record, subject to all just exceptions. Office to tag the same at appropriate place.

Learned State counsel submits that there are total seven accused and present petition has been filed by only five accused. Therefore, submits that petition is not maintainable being partial quashing petition, which is not permissible under the law as well. Besides, all the victims including the complainant is required to be impleaded as party in the petition. 4.

On the statement of learned State counsel, counsel for the petitioners seeks withdrawal of present petition with liberty to file a fresh one by examining the issue.

Dismissed as withdrawn with liberty as sought and recorded here-above.
