(ORAL) In the present case, the grievance of the petitioners is that though they have discharged duties even on the Gazetted Holidays as well as on public holidays for which they are not being paid the salary despite the fact that as per the settled principles of law, in case an employee works on a holiday or a gazetted holiday, he/she is entitled for the salary for the same. On being asked to point out the facts qua working on a particular day, which was a holiday for which petitioners have not been paid, learned counsel has not been able to point out any such fact.

Learned counsel for the respondent submits that in case petitioner(s) files any representation giving the details of the holidays on which they have worked, the same will be considered in accordance with law after ensuring as to whether, in lieu of the said work done on a gazetted or a public holiday, the petitioners have been granted commensurate rest or not appropriate order will be passed on this claim raised. In case, the petitioners are found entitled for any relief for working on a gazetted holiday, the same will be given to them after passing the appropriate speaking order on their representation.

2023:PHHC:110276 CWP No.36567 of 2019 #2# Learned counsel for the petitioner(s) submits that the present petition may kindly be disposed of having been not pressed with liberty to approach the respondent by filing appropriate representation giving the details of the days, which were public or gazetted holiday, on which the petitioners discharged their duties and have not been paid the salary for the same despite their entitlement.
