The learned counsel representing the appellants submits that the parties have entered into an out of court settlement and the sale deed has been partly complied with as the respondents have executed the sale deed for the land measuring 9 acres. He submits that the sale deed for another 2 acres of land is yet to be executed. He further submits that the present appeal be dismissed for non-prosecution with the liberty to the appellants to revive the same.
