Ms. Vaishali Kamboj, Advocate for respondent No.2. **** ANOOP CHITKARA, J. (ORAL) Ms. Vaishali Kamboj, Advocate has substituted the previous counsel Mr. R.S. Budhwar, Advocate for respondent No. 2 and filed her power of attorney after taking no objection from the previous counsel, which is taken on record. Counsel for the petitioner seeks cancellation of bail on the grounds that the conditions of the bail order dated 19.11.2019 passed by learned Sessions Judge, Hisar were violated and respondent No. 2 never joined investigation. State counsel on instructions submits that although the petitioner had joined the investigation but he did not cooperate with the investigation. Be that as it may, counsel for respondent No. 2/accused on instructions prays that the bail may not be cancelled, even further stringent conditions may be put upon him.

In the entirety of facts and circumstances and given the undertaking of counsel for respondent No. 2/accused that respondent No.2 shall comply with the stringent conditions, the bail order dated 19.11.2019 is upheld, subject to the additional following condition:

Within fifteen days from today, the petitioner shall forward to the Investigator/SHO and the complainant/victim(s) the complete details of bank account numbers with addresses, fixed deposits, DEMAT account numbers, the current market value of jewelry, sovereign metals, all precious articles, JYOTI 2023.01.17 11:34 I attest to the accuracy and integrity of this order/judgment.

CRM-M-53870-2019 -2It is clarified that in case the bail order dated 19.11.2019 is not complied with and assets are not disclosed within stipulated time then on this ground alone, the bail shall be cancelled.
