 The grievance of the petitioner, who happens to be an accused in a trial arising out of FIR No. 110 dated 15.07.2016 under Section 379B of the Indian Penal Code registered at Police Station Dharamkot, District Moga, is that since filing of the chargesheet on 18.01.2024 before the trial Court, even charges have not been framed as yet against the accused persons. 2.

Learned State counsel informs that due to other coaccused being absconding against whom proceedings under Sections 82/83 of the Code of Criminal Procedure for declaring them as proclaimed absconders have already been initiated on 23.10.2023, the trial is delayed. 3.

Since offence in question attracts maximum sentence of 10 years, it is incumbent upon the trial Court to conclude the proceedings as expeditiously as possible preferably within a period of six months. Trial Court is free to exercise all coercive steps against the absconding coaccused with the ultimate object to conclude the trial expeditiously. 4.
