*** Daya Chaudhary, J. (Oral) The present petition has been filed by petitioner-Maddi under Section 439 Cr.P.C. for grant of regular bail to him in case FIR No.140 dated 18.07.2017 registered under Sections 307 read with Section 34 IPC at Police Station City Moga, District Moga during pendency of trial. Learned counsel for the petitioner submits that the petitioner is in custody since 05.09.2017. Out of total 17 prosecution witnesses, four witnesses including the complainant have been examined. Co-accused of the petitioner, Jagdeep Singh, has already been released on regular bail by this Court vide order dated 06.12.2017 passed in Criminal Misc. No. M45590 of 2017. No other case is pending against the petitioner.
Learned State counsel has not disputed the custody period and release of co-accused on regular bail by this Court but has opposed grant of regular bail to the petitioner on the ground of seriousness of offence. Heard arguments of learned counsel for the petitioner as well as NEETU RANI 2019.01.
