Petitioner has come up before this Court under Section 379 of BNSS, 2023 with prayer to launch prosecution by filing complaint against respondent for the offences under Sections 193, 199, 209 IPC for filing false affidavit in quashing petition i.e. CRM-M No.54910 of 2023.

On an inquiry, counsel for the petitioner submits that the quashing petition titled 'Sandhya Kaushik v/s State of Haryana' in which respondent has filed the affidavit is still pending.

Since the petition is pending, petitioner may file an application in that petition or may file after decision of the same.

Given above, the present petition is disposed of. Liberty reserved to come to this Court after decision of the said petition if the cause of action still survives. It is clarified that withdrawal of present petition shall not come in the way of the petitioner. All pending applications, if any, stand disposed of.
