Learned counsel for the petitioner argues that he has been transferred from Charkhi Dadri to Kurukshetra in mid-term and which is 150 KM away. Learned counsel for the petitioner submits that the petitioner has to take care of his specially abled son who is 80 % disabled and is getting treatment from PGIMS Rohtak. Learned counsel for the petitioner argues that in case the impugned order of transfer is implemented it will be difficult to the petitioner to take care of his disabled son who will not be able to get proper medical treatment in case the petitioner got transferred as there is no one to look after his disabled son of except the wife of the petitioner. 2.

Learned counsel for the petitioners submits that the petitioner has already submitted a representation dated 22.11.2023 (Annexure P-7) by giving all the details of his family circumstances including the medical status of his disabled son, but the same is still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a direction is issued to the respondents to decide the said representation in a time bound manner by taking a sympathetic view that the petitioner can be transferred at nearby place including Bhiwani in case, the posts are lying RIYA 2023.12.02 12:52 I attest to the accuracy and integrity of this document

On the asking of the Court, Mr. Harish Nain, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondent-State and submits that in case, the representation dated 22.11.2023 (Annexure P-7) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be decided by the competent authority within a period of six weeks of the receipt of certified copy of this order by taking sympathetic view and if feasible appropriate action will be taken in case the petitioner can be posted at a nearby place to Rohtak so that the son of the petitioner can be taken care of in case of medical emergency, by passing an appropriate speaking order. 5.

Learned counsel for the petitioners submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 6.
