On 12.04.2023 the following order was passed : "Learned counsel for the appellant states that he has no instructions regarding the compromise as despite his repeated efforts he has not been able to contact the appellant.

Let notice of the appeal be issued to the appellant, returnable 15.11.2023."

As per office report, the appellant was not found present at the time of service and hence affixation was made. However, none has put in appearance on behalf of the appellant.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 4.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
