Having heard learned counsel for the petitioner, this Court finds that in the present case report under Section 173 Cr.P.C. has already been filed and the matter is now fixed before the Trial Court to consider the framing of charges. Under these circumstances, the instant petition is disposed of with liberty to the petitioner to raise all the pleas as have been raised herein before the Trial Court at appropriate stage.

Needless to mention, the petitioner would be at liberty to raise his plea to the effect that while some of the PWs, whose statements had been recorded under Section 161 Cr.P.C., had not fully supported the case of the prosecution, but subsequently after about 31⁄2 months statement of one more PW was recorded under Section 161 Cr.P.C. making certain improvements in the case of the complainant and that, under these circumstances, it is apparent that the petitioner has been falsely implicated.
