MANJARI NEHRU KAUL, J. (ORAL) After arguing for some time, when this Court was not inclined to extend the concession of anticipatory bail in view of the allegations levelled against the petitioner, coupled with his criminal antecedents, a prayer was made by learned counsel for the petitioner for withdrawal of the instant petition.

Dismissed as not pressed.

At this stage, learned counsel for the petitioner submits that the petitioner would appear and surrender before the trial Court within the next three days and on his surrender, he would move an application under Section 439 of the Cr.P.C., which be decided expeditiously by the trial Court.

In view of the undertaking given by the learned counsel for the petitioner, the petitioner shall positively surrender on or before 15.01.2024 before the trial Court. In case the petitioner, on surrender, moves an application under Section 439 of the Cr.P.C., the trial Court shall make earnest efforts to decide it expeditiously, in accordance with law.
