Deepak v. State Of Haryana
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-54182-2019 Decided on : 07.01.2020 Deepak . . . Petitioner(s)
Versus
State of Haryana . . . Respondent(s) CORAM: HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL PRESENT: Mr. Munish Kumar Garg, Advocate for the petitioner(s).
Mr. Ashish Sanghi, DAG, Haryana.
**** MANJARI NEHRU KAUL , J. (Oral) The instant petition has been filed under Section 439 Cr.P.C., for grant of regular bail, in case FIR No. 282, dated 07.11.2018, under Sections 342, 343, 506 IPC and Section 6 of the POCSO Act, 2012, registered at P.S. Sadar Narwana, Distt. Jind. Learned counsel contends that the petitioner has been in custody since 08th November, 2018 and out of 13 prosecution witnesses only 02 witnesses have been examined till date, a fact which has not been controverted by the learned State counsel as well. It has been further contended that the prosecutrix despite having been bound by the Court below has not been appearing for the last as many as four dates of hearings, as a result of which the trial is getting prolonged. Without commenting on the merits of the case, lest it may prejudice the rights of the accused, the instant petition stands dismissed. However, in view of the submissions made hereinabove, the trial Court is directed to ensure that the trial is concluded expeditiously, preferably, within four months from today.
