RAMENDRA JAIN, J. (ORAL) The case has been taken up for hearing through video conferencing.

By this common order, I shall dispose of above-titled two petitions under Section 439 Cr.P.C. for grant of regular bail to petitioners namely, Laxman, Rohtash (CRM-M-54060 of 2019) and Parvinder @ Chotu (CRM-M-499 of 2020) in a case arising from FIR No.0083 dated 03.08.2018 registered under Sections 148, 149, 323, 341, 302 IPC at Police Station Rohrai, District Rewari.

Learned counsel inter alia contend that co-accused of the RAVINDER SINGH 2020.06.24 11:33 I attest to the accuracy and integrity of this document

-2CRM-M-54060 of 2019 petitioner, namely, Rinak Pal @ Rinku, whose role is akin to that of petitioners, has been enlarged on regular bail by a Co-ordinate Bench of this Court vide order dated 11.12.2019 passed in CRM-M-61780 of 2018. Petitioners Laxman and Rohtash are in custody since 13.08.2018 whereas Parvinder @ Chotu is in custody since 31.08.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioners in jail any more. Treating the case of the petitioners on the same parity as that of their aforesaid co-accused, they may also be granted concession of regular bail.

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioners. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, treating the case of the petitioners on the same parity as that of their co-accused, namely, Rinak Pal @ Rinku, petition is allowed. Consequently, petitioners - Laxman, Rohtash and Parvinder @ Chotu - are ordered to be released on bail during pendency of trial, if not required in any other case, on their furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
